At Sysick Technologies LLC (“Sysick Technologies,” “Sysick,” “we,” “us,” or “our”), we provide customized digital and technology services, including web development, software development, AI automation, digital marketing, advertising management, consulting, and related services.
Because our services involve customized work, dedicated resources, project planning, development time, and third-party expenses, our refund policy differs from that of a traditional retail business.
By purchasing or engaging our services, you acknowledge and agree to the terms of this Refund & Cancellation Policy.
1. General Refund Policy
Unless otherwise stated in a written proposal, statement of work, service agreement, or invoice, payments for services are generally non-refundable once work has commenced.
This is because project resources may be allocated, work may have already been performed, and third-party costs may have been incurred.
Before making a payment, clients are encouraged to review the applicable proposal, scope of work, deliverables, timeline, and payment terms carefully.
2. Project Deposits and Upfront Payments
For custom projects, we may require an upfront deposit before beginning work.
Once work has commenced, the deposit is generally non-refundable.
This includes projects such as:
- Website development
- E-commerce development
- Custom web applications
- Software development
- AI automation projects
- UI/UX design
- Website redesigns
- Technical integrations
- Other custom development projects
If a project is cancelled after work has started, the deposit may be retained to cover work performed, resources allocated, administrative costs, and other expenses incurred by Sysick Technologies.
3. Cancellation Before Work Begins
If a client cancels a project before work has commenced, Sysick Technologies may, at its discretion, issue a partial or full refund of amounts paid.
Any third-party fees, transaction fees, administrative costs, or other non-refundable expenses already incurred may be deducted from the refund.
Whether work has commenced will be determined based on our project records, including planning, research, strategy, design, development, account setup, meetings, or other preparatory activities performed for the project.
4. Cancellation After Work Has Commenced
If a client cancels a project after work has commenced:
- Amounts corresponding to work already completed remain payable.
- Non-refundable deposits may be retained.
- Third-party expenses remain the client’s responsibility.
- Any outstanding invoices must be paid according to the applicable agreement.
- Unused portions of prepaid services may be reviewed for a potential discretionary refund where appropriate.
If the amount already paid exceeds the value of work completed and applicable expenses, Sysick Technologies may, at its discretion, refund some or all of the remaining unused balance.
5. Monthly Retainers
For recurring services such as:
- Digital marketing
- Meta Ads management
- Google Ads management
- Social media management
- Website maintenance
- AI automation maintenance
- Consulting
- Other ongoing services
the applicable agreement or invoice will specify the cancellation and notice period.
Unless otherwise agreed in writing, monthly retainer payments are non-refundable once the applicable service period has begun.
If a client wishes to cancel a recurring service, written notice should be provided before the next billing period begins.
Cancellation will generally take effect at the end of the already-paid service period unless otherwise agreed.
6. Advertising Spend
Advertising budgets paid to third-party advertising platforms are separate from Sysick Technologies’ service fees.
This may include advertising spend paid to platforms such as:
- Meta
- TikTok
- Other advertising platforms
Once advertising funds have been deposited into or spent through a third-party advertising platform, Sysick Technologies cannot guarantee a refund.
Any refund of unused advertising funds is subject to the policies and procedures of the applicable advertising platform.
Sysick Technologies is not responsible for advertising platform fees, rejected advertisements, account restrictions, suspended accounts, or other platform-related issues outside our control.
7. Third-Party Products and Services
Our projects may involve third-party products or services, including:
- Hosting
- Domain registration
- Premium plugins
- Software licenses
- SaaS subscriptions
- AI platforms
- API services
- Stock assets
- Themes
- Fonts
- Payment platforms
- Advertising platforms
- Other third-party tools
Third-party purchases may be non-refundable and are subject to the respective provider’s refund policy.
If Sysick Technologies purchases a third-party service on behalf of a client, the client remains responsible for the applicable cost where that cost was previously approved or included in the agreed project scope.
8. Website and Software Development Projects
For website and software development projects, refunds are generally not available for dissatisfaction with subjective design or functionality preferences when the delivered work substantially follows the agreed scope.
We will make reasonable efforts to address legitimate issues and implement revisions included within the agreed scope.
Requests that substantially change the original project requirements may be treated as additional work and may require an additional fee.
Examples include:
- Changing the original website structure;
- Adding new functionality;
- Introducing new integrations;
- Changing the approved design direction;
- Adding new pages or features;
- Changing the original business requirements; or
- Requesting functionality that was not included in the original scope.
9. Revision Requests
Where revisions are included in a project, they must remain reasonably consistent with the original agreed scope.
A revision does not constitute grounds for a refund where Sysick Technologies has delivered the agreed work and is willing to make reasonable revisions within the agreed scope.
Additional revisions beyond the agreed limit may be billed separately.
10. Service Delays
A delay in project completion does not automatically qualify a client for a refund.
Project timelines may be affected by:
- Delayed client feedback;
- Missing content or materials;
- Delayed approvals;
- Changes in requirements;
- Third-party platform issues;
- Hosting or domain issues;
- API limitations;
- Technical complications;
- Regulatory or platform restrictions; or
- Circumstances outside our reasonable control.
Where a delay is caused primarily by Sysick Technologies, we will make reasonable efforts to communicate the issue and establish a revised delivery timeline.
11. Digital Marketing and Performance Services
Fees paid for marketing strategy, campaign management, optimization, consulting, creative direction, reporting, or related professional services are generally non-refundable once the service period has begun.
Marketing results are affected by numerous factors outside our control.
Therefore, we do not provide refunds solely because a campaign does not achieve a particular:
- Number of leads;
- Cost per lead;
- Conversion rate;
- Revenue;
- Return on ad spend (ROAS);
- Cost per acquisition;
- Sales volume; or
- Other performance target,
unless a specific performance guarantee has been expressly agreed upon in writing.
12. Client Non-Responsiveness
If a client becomes unresponsive or fails to provide required information, approvals, content, credentials, or feedback, the project may be paused.
Such delays do not automatically create a right to a refund.
If a project remains inactive for an extended period because of client inactivity, Sysick Technologies may consider the project paused, rescheduled, or terminated depending on the circumstances and applicable agreement.
Additional fees may apply if substantial work is required to restart a dormant project.
13. Refund Requests
Refund requests must be submitted in writing to:
A refund request should include:
- Client name;
- Company name, if applicable;
- Invoice or project reference;
- Date of payment;
- Amount paid;
- Reason for the refund request; and
- Any relevant supporting information.
We will review refund requests based on the applicable proposal, service agreement, scope of work, invoices, project status, and this policy.
14. Approved Refunds
If a refund is approved, it will generally be issued to the original payment method, where technically possible.
Processing times may vary depending on the payment processor, bank, card issuer, or other financial institution involved.
Sysick Technologies is not responsible for delays caused by third-party financial institutions.
15. Chargebacks and Payment Disputes
Before initiating a chargeback or payment dispute with a bank, card issuer, or payment provider, we strongly encourage clients to contact us at finance@sysick.com so that we can attempt to resolve the issue directly.
Unauthorized or fraudulent chargebacks may result in suspension or termination of services and may be contested with relevant documentation.
This provision does not limit any rights available to consumers under applicable law.
16. Exceptions
Although our standard policy is that payments become non-refundable once work has commenced, Sysick Technologies may consider exceptions in exceptional circumstances.
Any exception is made at our sole discretion and does not establish an obligation to provide the same exception in another situation.
Where a separate written agreement provides different refund or cancellation terms, that agreement will control.
17. No Physical Product Returns
Sysick Technologies primarily provides digital and professional services.
We do not generally sell physical products through our website. Accordingly, traditional product return or exchange policies do not apply to our services.
18. Changes to This Policy
We may update this Refund & Cancellation Policy from time to time.
Any updated version will be published on this page with a revised “Last Updated” date.
The policy applicable to a particular project will generally be the version agreed to or incorporated into the applicable service agreement at the time of engagement, unless otherwise required by law.
